Jerry Anderson II v. Marquette Branch Prison Warden

LC No. 20-059661-AH

James Robert Redford Presiding Judge Kirsten Frank Kelly Anica Letica Judges

ORDER

The motion to make up oral argument is DENIED. Although the court rules provide a party with an opportunity to appear for in-person oral argument if properly requested, MCR 7.212(C)(1); MCR 7.214(A), the rules do not confer an absolute right to appear for oral argument, MCR 7.214(E). Nor is there any support for the conclusion that Const 1963, art 1, § 13 grants a right, absolute or otherwise, to attend oral argument on direct appeal. Because the loss of oral argument did not deprive petitioner of his right to have his appeal heard and decided by this Court, and because petitioner makes no attempt to show prejudice, he has identified no harm needing relief. This Court did not abuse its decision when it heard petitioner's appeal on briefs. MCR 7.214(E)(1)(b).
