Opinion

December Term, 1824.


This being a case wherein satisfactory evidence has been adduced to the Court that it was the design of the judge who tried it to make up a statement to be transmitted to this Court, which from some cause or other has been omitted, there must of necessity, be a new trial. Hamilton v. McCulloch, 9 N.C. 29.

New trial.
