Opinion

No. 91-2791.

November 6, 1992.

Appeal from the Circuit Court for Hernando County; Richard Tombrink, Jr., Judge.

Frank McClung, Brooksville, for appellants, cross-appellees.

Diane V. Kuenzel, Land O Lakes, for appellee, cross-appellant.

AFFIRMED.

GOSHORN, C.J., and HARRIS, J., concur.

DAUKSCH, J., dissents with opinion.

I respectfully dissent.

In my opinion the trial judge should have granted a mechanics lien against the real property improved by the efforts and expenditures of the appellee. Therefore, I would grant relief under the cross-appeal.
