ORDER


Plaintiffs filed the above entitled case on January 24, 2003. However, they have not served the defendants with the summons and complaint.

On October 23, 2003, the court issued an Order to Show Cause giving Plaintiffs until November 28, 2003 to show cause why the case should not be dismissed for failure to serve process on the defendants within 120 days as required by Rule 4(m) of the Federal Rules of Civil Procedure. To date. Plaintiffs have not filed a response to the court's order.

Accordingly, IT IS HEREBY ORDERED that the case be dismissed without prejudice for failure to serve process on the defendants.
