Tsuchida, United States Magistrate Judge, and the remaining record. It is hereby ORDERED that:
1. The Report and Recommendation is ADOPTED;
2. Defendants' motion for summary judgment is GRANTED; and
3. This case is DISMISSED WITH PREJUDICE.
