LARRY K. ANDERS, Appellant v. CROSSFIRST BANK, A KANSAS STATE BANK, Appellee

On Appeal from the 429th Judicial District Court Collin County, Texas Trial Court Cause No. 429-05551-2018

ORDER

BONNIE LEE GOLDSTEIN JUSTICE.

The clerk's record in this appeal was filed under seal on September 30, 2021. The record, however, did not include a sealing order that met the requirements under Texas Rule of Civil Procedure 76a. See Tex. R. Civ. P. 76a (concerning sealing court records). Accordingly, we gave the parties an opportunity to obtain a proper sealing order from the trial court.

On November 15, 2021, appellant informed us by letter that the trial court had signed a sealing order under Rule 76a. A supplemental clerk's record containing a copy of the order followed the next day. The order sealed a fraction of the documents included in the September 30th record. Those documents were also included in the corrected sealed record. The remaining documents were included in an unsealed record, the corrected Supplemental Clerk's Record, filed November 16th as well.

Based on the filings, we STRIKE the September 30th record. We RESET the deadline for the filing of appellant's brief and ORDER the brief be filed no later than December 16, 2021.
