Order reversed, without costs, and allowance reduced to $200 on the ground that the plaintiff not having succeeded as to the defense interposed the same should not be made the basis for an allowance to it, and on the further ground that the discretion of the court was improperly exercised. Cochrane, P.J., H.T. Kellogg, Van Kirk, Hinman and McCann, JJ., concur.
