Amos v. State

District Court of Appeal of Florida, Second District
Apr 22, 1994
635 So. 2d 154 (Fla. Dist. Ct. App. 1994)

Opinion

No. 92-04634.

April 22, 1994.

Appeal from the Circuit Court for Sarasota County; James S. Parker, Judge.

James Marion Moorman, Public Defender, and Kenneth D. Whitfield, Asst. Public Defender, Bartow, for appellant.

Robert A. Butterworth, Atty. Gen., Tallahassee, and Davis G. Anderson, Jr., Asst. Atty. Gen., Tampa, for appellee.

Shawn C. Amos appeals the conviction and sentence he received for failure to appear. The record shows that, although Amos received a sentence for failure to appear, an information charging this offense was not filed. Additionally, Amos never entered a plea to the charge. Accordingly, we reverse the conviction and vacate the sentence imposed for failure to appear.

HALL, Acting C.J., and ALTENBERND, J., concur.
