Amos Parrish & Co. v. Applestein

Appellate Division of the Supreme Court of New York, First Department
Oct 5, 1967
28 A.D.2d 979 (N.Y. App. Div. 1967)

Opinion

October 5, 1967

Order, entered on or about April 10, 1967, denying further examination of officers of plaintiff corporation, unanimously reversed, on the facts and on the law, with $30 costs and disbursements to appellants, and the motion therefor granted. It was error to limit defendants to an examination before trial of a single officer of plaintiff corporation where the record of the examination before trial demonstrated his lack of knowledge of material matters, and it appears that others have more direct and personal knowledge of the facts than the witness produced. Settle order on notice.
