OPINION

THE COURT: It is ordered that the opinion filed herein on December 15, 2008 be modified as follows:

1. On page 7, the second sentence in the first paragraph in the Discussion section beginning with “Although Indian tribes” and ending with “congressional authorization to sue.” is deleted and replaced with the following:

An Indian tribe’s sovereign nation status confers an absolute immunity from suit in federal or state court, absent an express waiver of that immunity or congressional authorization to sue.

There is no change in the judgment.
