For the reasons assigned in the companion case of American States Insurance Company v. Roark, 583 So.2d 570 (La.App. 3 Cir. 1991), we affirm the trial court judgment denying American States' writ on a motion for summary judgment.

All costs of court are assessed to American States Insurance Company.

AFFIRMED.
