In view of the unexplained delay in bringing on this appeal from an intermediate order, the nature of which dictated a prompt prosecution of an appeal, if any was to be taken, the court would not be warranted in reviewing in the discretion of Special Term. Order unanimously affirmed, with $20 costs and disbursements.
