ORDER REGARDING OBJECTIONS AND DISMISSING CASE
This matter is before the court on plaintiff's motion to dismiss the Gardner defendants. The court GRANTS the motion.
One procedural matter must be resolved first. In its March 4, 2004 order, the court stated that the Gardner defendants could review redacted copies of the then-pending motions for summary judgment. The order specified, `The redacted versions of these pleadings may remove any sensitive financial information and any information regarding settlement discussions." The Gardner defendants' objections to dismissal of this case appear to suggest this issue has not been resolved. The Gardner defendants may misunderstand the court's ruling. The court has permitted them access to the summary judgment pleadings, not the settlement agreement. The Gardner defendants are not entitled view to copies of the settlement agreement. Disclosure of the settlement information could unfairly alter the results of the related case pending in state court.
The Gardner defendants have raised no other motions that need to be resolved. In light of the Plaintiff's motion to dismiss and because the Gardner defendants have no claims remaining to be resolved, the court GRANTS the motion to dismiss.
The Gardner defendants suggest they may be entitled to attorneys fees. It is unclear why this is so. Nonetheless, if the Gardner defendants wish to file a motion for attorney's fees, they must do so by June 25, 2004. The Clerk's Office is directed to close the case.
