Opinion
No. AD-130.
March 15, 1982.
Appeal from an order of Deputy Commissioner J. Paul Jones, Jr.
Donna L. Bergh, Walker, Buckmaster, Miller Ketcham, Orlando, for appellants.
James M. Hess, Driscoll, Langston, Layton Kane, Orlando, for appellee.
There being no showing of causal connection between claimant's alleged misrepresentation on his employment application and his subsequent heart attack, the employer/carrier's Martin Company v. Carpenter, 132 So.2d 400 (Fla. 1961) defense must fail. The order of the deputy commissioner finding that claimant suffered a compensable heart attack is affirmed.
