AMANASU ENVIRONMENT CORPORATION, Petitioner v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

L. Paige Marvel Judge

A request has been made for a copy of the petition and other documents in the record in this case. Upon review of the record, the Court observed sensitive taxpayer information left unredacted in the (1) Petition (docket entry no. 1); (2) Motion To Dismiss for Lack of Jurisdiction (docket entry no. 11), and (3) Pretrial Memorandum (docket entry no. 13). The onus is on the parties in a proceeding in this Court to ensure compliance with Tax Court Rule 27(a), which instructs parties to refrain from including in any filing, whether paper or electronic, sensitive taxpayer information (e.g., Social Security numbers, taxpayer identification numbers, or financial account numbers). The Court will defer providing the requested copies of the documents to give the parties an opportunity to properly redact any unredacted documents in this case. In consideration of the foregoing, it is

ORDERED that the Clerk of the Court shall temporarily seal from public viewing the following documents in the record: (1) Petition (docket entry no. 1); (2) Motion To Dismiss for Lack of Jurisdiction (docket entry no. 11), and (3) Pretrial Memorandum (docket entry no. 13). It is further

ORDERED that on or before January 24, petitioner shall file with the Court a redacted version of the Petition (docket entry no. 1) and move to substitute the unredacted Petition. The redacted petition shall be clearly marked "REDACTED". The redacted petition shall be in all respects a duplicate of the original filing, including attachments, except that identifying taxpayer identification numbers shall be properly redacted in accordance with Tax Court Rule 27(a). It is further

ORDERED that on or before January 24, respondent shall file with the Court a redacted version of the Motion To Dismiss for Lack of Jurisdiction (docket entry no. 11) and move to substitute the unredacted Motion To Dismiss for Lack of Jurisdiction. The redacted motion to dismiss for lack of jurisdiction shall be clearly marked "REDACTED". The redacted motion to dismiss for lack of jurisdiction shall be in all respects a duplicate of the original filing, including attachments, except that identifying taxpayer identification numbers shall be properly redacted in accordance with Tax Court Rule 27(a). It is further

ORDERED that on or before January 24, petitioner shall file with the Court a redacted version of the Pretrial Memorandum (docket entry no. 13) and move to substitute the unredacted Pretrial Memorandum. The redacted pretrial memorandum shall be clearly marked "REDACTED". The redacted pretrial memorandum shall be in all respects a duplicate of the original filing, including attachments, except that identifying taxpayer identification numbers shall be properly redacted in accordance with Tax Court Rule 27(a).

If there is a failure to comply with this order, copies of the imperfectly redacted documents will be provided in response to the copy request.
