This case is calendared for trial at the New York City, New York, Trial Session of Court that is scheduled to begin on February 27, 2023. On January 28, 2023, petitioner filed a Motion to Remand. Respondent filed his Response to Motion to Remand on February 6, 2023. In his response, respondent stated, among other things, that he has no objection to remanding this case to Appeals for a supplemental hearing as requested by petitioner in the Motion to Remand, except that he does not agree that the hearing should be transcribed as originally requested in the motion. The parties have now agreed that the supplemental hearing will not be transcribed. Upon due consideration and for cause, it is
ORDERED that this case is stricken for trial from the February 27, 2023, New York City, New York, trial session and jurisdiction of this case is retained by the undersigned. It is further
ORDERED that petitioner's Motion to Remand, filed January 28, 2023, as modified by the agreement of the parties, is granted, and this case is remanded to respondent's Independent Office of Appeals for the purpose of conducting a supplemental hearing. It is further
ORDERED that the supplemental hearing shall take place at a reasonable and mutually agreed upon date, time and location, but no later than May 12, 2023. It is further
ORDERED that, on or before August 18, 2023, the parties shall file a joint report regarding the then-present status of this case.
