An appeal having been taken to this Court from the order and judgment (one paper) of the Supreme Court, New York County, entered on or about January 11, 2016, and said appeal having been perfected, And plaintiff-respondent having moved for dismissal of the aforesaid appeal (M-2043), And defendants-appellants having cross-moved for an extension of time to file a notice of appeal, or to deem the notice of appeal filed on March 4, 2016 to be timely, nunc pro tunc (M-2226), Now, upon reading and filing the papers with respect to the motion and cross motion, and due deliberation having been had thereon, It is ordered that the motion to dismiss the appeal is denied (M-2043). The cross motion is granted to the extent of deeming the appeal timely filed (M-2226).
