MEMORANDUM OPINION


Before the Court is appellant's January 21, 2004 motion to dismiss appeal. Appellant states that, during mediation, the parties agreed to compromise and settle their differences. Therefore, appellant moves to dismiss this appeal.

We GRANT appellant's motion and this appeal is DISMISSED. See Tex.R.App.P. 42.1(a).
