On July 10, 2017, the Clerk of this Court notified the appellees that their third extension request was granted until August 17, 2017, with no further extensions. Because the appellees' fourth extension is unopposed, only seeks six days, and was the first request after this Court's July 13, 2017 Memorandum Order denied appellees' motion to restore their cross-appeal, this extension is granted, but counsel is warned that no further extensions will be granted. See TEX. R. APP. P. 10.5(b)(1)(C), 38.6(d). Accordingly, if the appellees' brief is not filed by August 23, 2017, this Court will set this appeal for submission on appellant's brief only. See id. 38.9(a).
