Opinion
NUMBER 13-17-00086-CV
11-30-2017
OCTAVIO ALVAREZ, Appellant, v. SERGIO MOLINA D/B/A NARSE CONSTRUCTION, Appellee.
On Appeal from the County Court at Law No. 7 of Hidalgo County, Texas.
ORDER
Before Justices Rodriguez, Benavides, and Longoria
Order Per Curiam
This cause is before the Court on appellee's opposed second motion for extension of time to file the brief. Appellee's brief was originally due to be filed on August 21, 2017, and this Court has previously granted appellee an extension of 78 days to file appellee's brief in this cause. Appellee has now filed a second motion requesting until April 19, 2018 to file the appellate brief in this cause.
The Court, having fully examined and considered appellee's second motion for extension of time to file the brief and the extension previously granted in this cause, is of the opinion that, in the interest of justice, appellee's second motion for extension of time to file the brief should be granted with order. The Court, however, looks with disfavor upon the delay caused by counsel's failure to have filed a brief in this matter.
The Court GRANTS IN PART and DENIES IN PART appellant's second motion for extension of time. This motion is GRANTED insofar as the Court will extend appellant's deadline to file his brief until February 26, 2018. This motion is DENIED insofar as the Court will not allow an extension until April 19, 2018. The Honorable Joseph A. Connors III, counsel for appellee, is hereby ORDERED to file the appellate brief with this Court on or before February 26, 2018. No further extensions will be granted absent exigent circumstances.
PER CURIAM Delivered and filed the 30th day of November, 2017.
