ORDER

PER CURIAM.

Pursuant to Texas Rule of Appellate Procedure 10.4 (a) the motion ruled on through this Order may have been decided by a single Justice sitting on the panel.

Pending before the Court is a motion to withdraw as counsel of record filed by Todd Morten. The motion states that Mr. Morten has determined that there may be a potential conflict of interest and he requests that we remand this cause to the trial court for appointment of new appellate counsel.

It is therefore ORDERED that this cause is abated and remanded to the trial court for a hearing to determine whether appointment of new appellate counsel is necessary. If new counsel is required, the trail court shall grant Mr. Morten's withdrawal and appoint new counsel. If Mr. Morten will proceed as appellate counsel, the trial court shall make findings stating the same.

The trial court shall forward all relevant findings and orders to the District Clerk of El Paso County, Texas, on or before December 10, 2024 for inclusion in a supplemental clerk's record that shall be filed in this Court on or before December 20, 2024.

IT IS SO ORDERED.
