ORDER ADOPTING FINDINGS, CONCLUSIONS AND RECOMMENDATION OF THE UNITED STATES MAGISTRATE JUDGE


After making an independent review of the pleadings, files and records in this case, and the findings, conclusions and recommendation of the United States Magistrate Judge, the Court finds that the findings and conclusions of the Magistrate Judge are correct and they are adopted as the findings and conclusions of the Court.

JUDGMENT

The Court having heretofore entered its Order Adopting the Findings, Conclusions and Recommendation of the United States Magistrate Judge in this case,

Petitioner has failed to make a substantial showing of the denial of a federal right. Respondent's Motion for Summary Judgment is GRANTED. It is therefore ORDERED, ADJUDGED and DECREED that all relief requested by Petitioner is DENIED

It is further ORDERED that the Clerk shall transmit a true copy of this Judgment, together with a true copy of the Order Adopting the Findings, Conclusions, and Recommendation of the United States Magistrate Judge, to the parties.
