IN THE MATTER OF JONATHAN ALVARADO, PETITIONER, v. ANTHONY ANNUCCI, ACTING COMMISSIONER, NEW YORK STATE DEPARTMENT OF CORRECTIONS AND COMMUNITY SUPERVISION, RESPONDENT.


PRESENT:

Respondent having moved for an extension of time to file and serve a brief on this CPLR article 78 proceeding transferred to this Court by an order of the Supreme Court entered in the Office of the Clerk of the County of Wyoming on August 23, 2018, and having moved to put the proceeding over term,

Now, upon reading and filing the affirmation of Joseph M. Spadola, Esq., dated November 8, 2018, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted insofar as it seeks an extension of time to file and serve a respondent's brief, on the condition that the brief is filed and served on or before January 10, 2019, and the Clerk is directed to accept the brief for filing, and

It is further ORDERED that the motion insofar as it seeks to put the proceeding over term is granted, and the proceeding is removed from the day calendar of this Court for January 7, 2019, and is added to the term of this Court commencing February 19, 2019.
