MEMORANDUM OPINION


By letter dated September 4, 2009, we notified appellant that the filing fee for the appeal was due. We directed appellant to remit the filing fee within ten days. We warned appellant that failure to comply would result in dismissal of the appeal without further notice. To date, appellant has neither paid the filing fee nor otherwise communicated with the Court regarding his appeal. Accordingly, we dismiss the appeal. See Tex. R. App. P. 42.3(c).
