MARK ALOE & CAROL ALOE, Petitioners, v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Tamara W. Ashford Judge

This case is currently calendared for trial at the Session of the Court commencing on May 1, 2023, in Pittsburgh, Pennsylvania. On February 27, 2023, respondent filed a Motion for Summary Judgment, along with a Declaration of Lisa DiCerbo in Support of Motion for Summary Judgment. The motion states that on February 17, 2023, respondent's counsel called petitioners' counsel to determine if petitioners object to the granting of this motion and left a voicemail message; petitioners' counsel, however, has not returned the call yet. Upon due consideration, it is hereby

ORDERED that, on or before April 5, 2023, petitioners shall file with the Court and serve on respondent a response to respondent's Motion for Summary Judgment. Failure to respond as required by this Order may be deemed consent to the relief sought in the motion.
