MEMORANDUM OPINION


Talmadge Elvin Almond was convicted of driving while intoxicated. See Tex. Pen. Code Ann. § 49.04 (Vernon 2003). The trial judge assessed punishment at ninety days in jail, probated for one year, and a $250 fine. We adopted the trial judge's finding that appellant abandoned the appeal and we submitted the appeal without briefs. Absent briefs, no points of error are before us. Finding no fundamental error, we affirm the trial court's judgment.
