Appellant has filed an Agreed Motion to Effectuate Settlement, stating the parties have reached an agreement to settle this dispute and dismiss the case with prejudice. Appellant requests that this court set aside the trial court's judgment and dismiss this appeal. The motion does not reflect any agreement regarding costs. We grant the motion, vacate the trial court's judgment without reference to the merits, and dismiss this appeal as moot. See TEX. R. APP. P. 42.1(a)(2)(A), 43.2(e). Because the parties have not indicated any agreement regarding costs, costs are taxed against appellant. See TEX. R. APP. P. 42.1(d); 43.4.
