DECISION & ORDER ON MOTION

Motion by appellant on an appeal from an order of the District Court of Nassau County, First District, entered January 4, 2011, for an order substituting the public administrator as representative for respondent in view of his death, and for a stay pending said appointment.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the motion is denied without prejudice to renewal upon service upon the public administrator (see 3A Carmody-Wait 2d § 19-254).
