Allstate Insurance Company v. Dominique Jamia Johnson

LC No. 20-009080-NF

Christopher M. Murray Presiding Judge, Thomas C. Cameron, Kristina Robinson Garrett Judges.

ORDER

Christopher M. Murray Presiding Judge.

The application for delayed leave to appeal is GRANTED. The time for taking further steps in this appeal runs from the date of the Clerk's certification of this order. MCR 7.205(E)(3). We note that the application raises a single issue, which is whether this Court should grant the application in order to restore defendant's right to an appeal where counsel erroneously filed a claim of appeal in the circuit court rather than this Court. The application does not specifically raise an issue challenging the merits of the trial court's decisions. Accordingly, and pursuant to MCR 7.205(E)(4), the Court directs the parties to address on appeal whether the circuit court erred by granting summary disposition in plaintiffs favor, and whether the trial court was correct to deny leave to amend defendant's answer to the complaint. If defendant wishes to raise any other issues in this appeal, she may file a motion requesting leave of this Court to do so. It is not necessary for the parties to further address defendant's counsel's error in filing a claim of appeal in the circuit court.
