Allright of Miami, Inc. v. Oesterle

District Court of Appeal of Florida, Third District
May 26, 1987
507 So. 2d 771 (Fla. Dist. Ct. App. 1987)

Opinion

No. 86-820.

May 26, 1987.

Appeal from the Circuit Court for Dade County, Rosemary Usher Jones, J.

Lanza and O'Connor and William R. Lemos, Coral Gables, for appellant.

Sams Ward, P.A., Cooper, Wolfe Bolotin, P.A., and Marc Cooper and Maureen E. Lefebvre, Miami, for appellee.

Before SCHWARTZ, C.J., and DANIEL S. PEARSON and JORGENSON, JJ.

We reverse the order of the trial court denying the motion of Allright of Miami, Inc., for a new trial. We agree with Allright that the trial court erred in admitting evidence of Oesterle's reputation for truthfulness in the absence of any attack upon her character. General Tel. Co. v. Wallace, 417 So.2d 1022 (Fla.2d DCA 1982); § 90.609(2), Fla. Stat. (1985). Accordingly, we reverse and remand for a new trial.

Reversed and remanded.
