MOTION DECISION

Plaintiff having moved, pursuant to CPLR 5704(a), for certain relief denied by a Justice of the Supreme Court, New York County, on or about March 10, 2022, granting plaintiff leave to file a motion in Supreme Court for partial summary judgment declaring the validity and enforceability of the parties' Prenuptial Agreement and that said agreement fixes June 1, 2018 as the valuation date for the parties' two jointly-titled residences acquired during the marriage, or in the alternative, directing the Supreme Court to sign the order to show cause, hear and determine the motion, and setting an immediate briefing schedule on the motion to be followed by Supreme Court, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is denied.
