MEMORANDUM OPINION


Before the court is the December 4, 2003 joint agreed motion for disposition. As requested by the parties, without consideration of the merits, we vacate the trial court's orders dated September 5, 2003 and September 26, 2003 regarding the anti-suit injunction. See Caballero v. Heart of Tex. Pizza, L.L.C., 70 S.W.3d 180, 180 (Tex. App.-San Antonio 2001, no pet.). Further, as agreed by the parties, this appeal is dismissed. See Tex.R.App.P. 42.1(a)(2). The Clerk is directed to issue the mandate simultaneously with the issuance of this court's opinion and judgment. See Tex.R.App.P. 18.1. Costs of appeal are taxed against the appellants. See Tex.R.App.P. 42.1(d).
