On the court's own motion, it is ORDERED that the order of this court dated June 17, 2013, which dismissed an appeal from an order of the Civil Court of the City of New York, Kings County, entered September 24, 2012, is recalled and vacated and the appeal is reinstated; and it is further,

ORDERED that respondent shall have 21 days from the date of this decision and order to serve and file a respondent's brief; and it is further,

ORDERED that appellant, if it be so advised, may serve and file a reply brief within 14 days of the date that the respondent's brief is due to be filed pursuant to this decision and order.
