JOHN RICHARD ALLEN, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 363rd Judicial District Court Dallas County, Texas Trial Court Cause No. F19-00144-W

ORDER

DENNISE GARCIA JUSTICE

We VACATE this Court's order of November 16, 2023, requiring the district clerk to file a supplemental clerk's record containing a copy of the jury charge. The trial court held a hearing concerning the jury charge on September 12, 2023. At that hearing, the parties submitted an agreed unsigned jury charge for purposes of the record, which is included in the reporter's record of the September 12, 2023 hearing, and the trial court found the reporter's record of the trial showed the jury unanimously found appellant guilty of aggravated sexual assault as charged in the indictment.

Appellant's brief is due DECEMBER 12, 2023, pursuant to this Court's order of November 14, 2023.

We DIRECT the Clerk to send copies of this order to Felicia Pitre, Dallas County District Clerk; and counsel for all parties.
