Allen v. State

District Court of Appeal of Florida, First District
Oct 26, 2001
798 So. 2d 818 (Fla. Dist. Ct. App. 2001)

Opinion

No. 1D01-2320.

October 26, 2001.

An appeal from the Circuit Court for Duval County. Judge Lance M. Day.

Willie Carl Allen, pro se.

Robert A. Butterworth, Attorney General, Tallahassee, for appellee.

Having not received a response to this Court's order of September 5, 2001, requiring appellant to show cause within 10 days from the date of the order why this appeal should not be dismissed, the above-styled cause is hereby dismissed on grounds that appellant's untimely motion for rehearing in the trial court did not toll the time for filing the notice of appeal.

MINER, WOLF and WEBSTER, JJ., concur.
