ORDER


The petition for a writ of habeas corpus is denied and the case dismissed for the reasons set forth in the Report and Recommendation of Magistrate Judge Mark D. Fox, dated August 28, 2002, to which no objection has been filed. As no substantial question is presented, a certificate of appealability is denied, and the Court certifies that any appeal herefrom would not be taken in good faith within the meaning of 28 U.S.C. § 1915(a)(3).

SO ORDERED.
