ORDER OVERRULING OBJECTIONS, ORDER ADOPTING REPORT AND RECOMMENDATION, and DISMISSING PETITION FOR A WRIT OF HABEAS CORPUS


Came this day for consideration the federal habeas corpus application filed by petitioner, TADAWNALLEN a state prisoner. On March 24, 2004, the United States Magistrate Judge issued a Report and Recommendation in this cause, recommending therein that the instant habeas application be dismissed for failure to exhaust state court remedies. Petitioner filed a document entitled "Petitioner's Objections to the Report and Recommendation" on April 9, 2004, however, as stated by petitioner therein, ". . .[T]hat she, Petitioner, has NO OBJECTIONS to said Court's ruling and recommendation not to file such Writ of Habeas Corpus in federal court, and that she has every intention to exhaust all state court remedies, as recommended by the federal court . . ."

The undersigned United States District Judge has made an independent examination of the record in this case. To the extent petitioner has objected, such objections are hereby OVERRULED, and the Magistrate Judge's Report and Recommendation is hereby ADOPTED. Accordingly, the petition for a writ of habeas corpus filed by petitioner is hereby DISMISSED for failure to exhaust state court remedies. Let judgment be entered accordingly.

IT IS SO ORDERED.
