Plaintiff James Allen, currently incarcerated at the Utah State Prison, has filed a suit pursuant to 42 U.S.C. § 1983 alleging that his constitutional rights have been violated. A Martinez Report was filed on this matter on May 18, 2000, along with a motion for summary judgment. On May 30, 2000, plaintiff filed a motion for extension of time to respond to the Martinez Report. Plaintiff claims among other things that he is waiting for documentation from the Salt Lake County Sheriff's Department regarding the incident in question. Plaintiff will be given until June 23, 2000, to respond to the Martinez Report and motion for summary judgment. If plaintiff does not have the documentation he needs, he should respond from his memory of the event.

Accordingly, IT IS HEREBY ORDERED that plaintiff be given until June 23, 2000, to respond to the Martinez Report and motion for summary judgment. If plaintiff does not respond by that date, the court will address the motions without the benefit of plaintiff's response.
