Ali Mohamad Aljabri & Badria Aljabri Petitioners v. Commissioner of Internal Revenue Respondent

ORDER

Joseph W. Nega Judge

This case was previously calendared for trial at the Court's April 20, 2020, San Francisco, California, trial session. By Order dated March 17, 2020, that trial session was cancelled due to concerns relating to coronavirus (COVID-19), and this case was assigned to the undersigned judge.

On August 17, 2021, respondent filed a Motion for Entry of Decision (respondent's motion) and attached thereto a proposed decision document. There are discrepancies, however, between the amounts shown in the table on page one of respondent's motion and the amounts shown in the proposed decision document attached as Exhibit A. The Court will therefore direct respondent to supplement respondent's motion with an explanation resolving the apparent discrepancies, or, if no explanation is available, to file a revised proposed decision document.

Accordingly, it is

ORDERED that, on or before November 24, 2021, respondent shall file either (1) a supplement to respondent's Motion for Entry of Decision filed August 17, 2021, explaining the apparent discrepancies identified herein, or (2) a revised proposed decision document. It is further

ORDERED that, on or before December 10, 2021, petitioners shall file with the Court a written response to either respondent's (1) supplement to the Motion for Entry of Decision, or (2) revised proposed decision document. Failure to respond as required by this Order may be deemed consent to the relief sought in the motion.
