Before the Court is appellee's January 19, 2024 motion to dismiss the appeal for appellant's failure to file a brief and appellant's response opposing the motion. Appellant's brief was due on January 11, 2024. In his response, appellant explains he has not filed a brief because he is waiting on appellee to confirm a date for "Court-ordered" mediation. This Court has not ordered the parties to mediation. We DENY appellee's motion. On the Court's own motion, we ORDER appellant to file his opening brief on or before February 21, 2024. We caution appellant that failure to file a brief on or before February 21, 2024 may result in dismissal of the appeal for want of prosecution without further notice. See TEX. R. APP. P. 38.8(A)(1).
