ORDER

Maurice B. Foley, Chief Judge

The petition in this case was filed on November 17, 2020. By Order issued January 11, 2021, the Court directed petitioner, on or before February 25, 2021, to file a proper amended petition and to pay the filing fee in this case.

On August 11, 2021, the Court entered its Order of Dismissal for Lack of Jurisdiction due to petitioner's failure to pay the filing fee and this case was closed. On September 13, 2021, petitioner submitted the filing fee.

Upon further review of the original petition filed November 17, 2020, the Court concludes that petition suffices, and that petitioner need not file an amended petition as directed in the Court's January 11, 2021, Order.

The foregoing considered and for cause, it is

ORDERED that the Court's Order of Dismissal for Lack of Jurisdiction, enter on August 11, 2021, is hereby vacated and set aside. It is further

ORDERED that, on or before November 3, 2021, respondent shall file an Answer to the petition.
