GARY W. ALEXANDER & DIANE M. ALEXANDER, Petitioners v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Kathleen Kerrigan Chief Judge.

On December 18, 2023, this Court received from petitioner Gary W. Alexander and filed a document titled "Appellant Response to Brief of the Appellee". Although the document contains, as an attached exhibit, the Order of Dismissal for Lack of Jurisdiction entered in this case on March 23, 2018, it appears that this document relates instead to petitioner's case at Docket No. 20069-22, which is currently on appeal to the United States Court of Appeals for the Ninth Circuit. Further, as it bears the docket number of petitioner's case on appeal, this document appears to relate specifically to petitioner's appellate case and should have been filed with the court of appeals rather than with this Court.

Upon due consideration of the above, it is

ORDERED that petitioner's Appellant Response to Brief of the Appellee is deemed stricken from the record in this case.
