ORDER

This substantiation case was on the Court's June 12, 2023 Buffalo, New York trial calendar. We continued it a third time only on the parties' representation that they'd reached a basis for settlement at IRS Appeals. That settlement broke down, but the parties asked for a bit more time to negotiate a settlement. They recently reported that they are already looking at computations, so this one may actually settle. We'll keep it on a status-report track for now, and it is

ORDERED that on or before June 24, 2024 the parties shall submit decision documents or file a joint status report describing their progress. If they have not settled, they should include their respective estimates of the time it will take to try this case.
