MICHAEL T. ALEGRIA & RINGA V. JUAREZ, Petitioners v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Joseph W. Nega Judge

This case is calendared for trial at the session of the Court to be conducted in person commencing Tuesday, September 6, 2022, in Fresno, California.

On August 15, 2022, the Court issued an Order directing petitioners to file on or before August 29, 2022, a response to respondent's Motion to Dismiss for Failure to Properly Prosecute filed August 11, 2022, as well as setting respondent's Motion to Dismiss for hearing at the Court's September 6, 2022, Fresno, California, trial session. Due to an inadvertent clerical error, the Court's August 15, 2022 Order incorrectly stated the time of that hearing on respondent's Motion to Dismiss as 10:00am (CT) instead of 10:00am (PST).

Accordingly, it is

ORDERED that the second ordered paragraph of the Court's Order issued August 15, 2022, at Docket Index No. 9 is amended to read:

ORDERED that respondent's Motion to Dismiss for Failure to Properly Prosecute filed August 11, 2022, is set for hearing on September 6, 2022, at 10:00 a.m. (PST). Petitioners are advised that failure to comply with this order or failure to appear at the hearing on September 6, 2022, may result in the Court granting respondent's motion and entering an order and decision against petitioners.

The Court's Order issued August 15, 2022, otherwise remain in full force and effect.
