Alderson BP, LLC, Seventh Street Development, Inc., Tax Matters Partner Petitioner v. Commissioner of Internal Revenue Respondent

ORDER

Mark V. Holmes, Judge

This case is on the Court's April 4, 2022 trial calendar for Los Angeles, California, and arises from an FPAA that centers on the characterization of real-estate dispositions as capital or ordinary. The parties predict a couple days of trial will be needed, but have some discovery left to be done before it is ready. In a phone call with the Court on March 18, 2022 they asked for the case to be moved to a status-report track while discovery is completed.

This seems an efficient way to proceed, so it is

ORDERED that this case is stricken from the Court's April 4, 2022 trial calendar. It is also

ORDERED that this division of the Court retains jurisdiction. It is also

ORDERED that on or before June 3, 2022 the parties shall file a status report to describe their progress in completing discovery and preparing the case for trial.
