Alcock v. City of Jacksonville

Supreme Court of Florida, en Banc
Feb 24, 1951
50 So. 2d 539 (Fla. 1951)

Opinion

January 5, 1951. Rehearing Denied February 24, 1951.

Certiorari to Circuit Court, Duval County; Claude Ogilvie, Judge.

H.P. Adair and Clarence G. Ashby, Jacksonville, for petitioners.

William M. Madison and Giles J. Patterson, and O.O. McCollum, Jr., all of Jacksonville, for respondents.

The petitioners seek by certiorari to review an order of the Circuit Court of Duval County denying a temporary injunction. The primary questions presented have been determined against the contentions of the petitioners, in the case of State v. City of Jacksonville, Fla., 50 So.2d 532. The petition should therefore be denied.

It is so ordered.

ADAMS, C.J., and CHAPMAN, THOMAS and HOBSON, JJ., concur.

TERRELL and ROBERTS, JJ., dissent.
