Al-Marri v. Hanft

United States District Court, D. South Carolina, Charleston Division
Nov 22, 2004
No. C/A: 2:04-2257-26AJ (D.S.C. Nov. 22, 2004)

Opinion

No. C/A: 2:04-2257-26AJ.

November 22, 2004

Miller W. Shealy, Assistant United States Attorney.

Andrew J. Savage, III Attorney for Petitioner.

SECOND ORDER FOR EXTENSION OF TIME

This matter is before the Court on motion of the Respondent for a Second Order extending the time for the Respondent to file a response in this matter.

The Respondent has requested an additional two weeks to serve and file it's response to Petitioner's motion requesting immediate access for counsel. It appears that counsel for Petitioner consents to this request.

This additional extension of time is warranted because the parties are engaged in ongoing discussions concerning the terms of the procedures governing counsel access to the detainee and a proposed protective order, as well as the handling of certain classified information. The parties hope that with this additional extension of time most, if not all, of these issues may be resolved without further involvement of the Court. THEREFORE, this Court finds that the Respondent's request is made for good cause shown and not for purposes of undue delay.

IT IS THEREFORE ORDERED, that the time for the Respondent to serve the response in this matter is extended an additional two weeks.

IT IS SO ORDERED.
