His authority should be assumed on the basis of his certification alone. 2020 ND 76, ¶ 10, 941 N.W.2d 529 (quoting Frost , 487 N.W.2d at 10 ). There is also a presumption that an official duty has been performed regularly.
, this Court reviews the Department's decision. See Christianson v. Henke, 2020 ND 76, ¶ 6, 941 N.W.2d 529. We give deference to the Department's findings of fact and review legal conclusions de novo.
[¶9] "Before documentary evidence is admissible, it must be authenticated." Christianson v. Henke, 2020 ND 76, ¶ 8, 941 N.W.2d 529 (citations omitted). Authentication requires evidence sufficient to support a finding that an item of evidence is what the proponent claims it is.
Christianson appealed that decision to this Court, and we reversed and vacated the judgment in April of 2020 because it was based on erroneously admitted evidence. Christianson v. N.D. Dep't of Transp. , 2020 ND 76, 941 N.W.2d 529. [¶3] In August of 2019, the Department issued Christianson an order of suspension for his noncommercial driver's license and order of disqualification for his commercial license (together referred to as suspension) based on his conviction for driving under the influence of alcohol in another jurisdiction.
