This case is currently set for trial during the Court's November 15, 2021, Dallas, Texas, remote trial session. On October 7, 2021, respondent filed a Motion to Dismiss for Lack of Prosecution (Doc. 6). In the motion, respondent moves the Court to dismiss the case and find in its order that there is due from petitioners for the taxable year 2017 a deficiency in tax of $3,858.00, and no addition to tax due pursuant to I.R.C. section 6662. Upon due consideration, it is hereby
ORDERED that, immediately upon receiving this order, but no later than October 27, 2021, petitioners shall telephone Karen Jones, Chambers Administrator of the undersigned judge, at (202) 521-0760, for the purpose of scheduling a pretrial telephone conference. It is further
ORDERED that, on or before November 3, 2021, petitioners shall serve on respondent and file with the Court a response to respondent's Motion to Dismiss for Lack of Prosecution. It is further
ORDERED that respondent's Motion to Dismiss for Lack of Prosecution is set for remote hearing on November 15, 2021, at 10:00 a.m. (Central Time). Petitioners are advised that failure to comply with the terms of this Order or failure to appear at the remote hearing on November 15, 2021, may result in the Court granting respondent's motion and entering an order and decision against petitioners.
The parties shall refer to the Notice Setting Case for Trial (Doc. 4) for the Zoomgov Meeting ID and Passcode.
This Order constitutes official notice to the parties.
