It is Ordered that respondent-appellant's motion for a stay is granted on condition that respondent-appellant: 1- perfects his appeal by no later than the June 2013 term - the filing deadline is April 9, 2013, and 2- pays accruing use and occupancy in the amount of $1,031.79 to petitioner on each subsequent rental due date, without prejudice. In the event of respondent-appellant's failure to comply with the foregoing conditions, petitioner-respondent may move, on five days' notice for an order vacating the stay and dismissing the appeal.

This Court's order entered March 11, 2013 is hereby recalled and vacated.
